Club NYC Terms of Service

Last updated:

Early access This is a plain-language policy for a game in early access.

The Short Version

  • Club NYC is a free game for people 13 and older. Depending on where you live, you may also need a parent’s or guardian’s permission.
  • Follow the Community Rules. If you break them, we can warn, mute, suspend or ban your account.
  • Coins and items are just for fun. They have no real-money value, can’t be bought, sold or cashed out, and we may adjust them.
  • You’re responsible for what you say and post. You let us show it in the game, and we can remove it.
  • The game is in early access and provided “as is”, so it may change, break or go offline.
  • These terms are governed by the laws of [GOVERNING STATE].

1 Agreeing to These Terms

These terms are an agreement between you and [COMPANY NAME] (“we” or “us”), which runs Club NYC. When you create your New Yorker, you tick a box to agree to these terms, our Privacy Policy and our Community Rules (which are part of these terms), and we keep a record of which version you agreed to and when. Our Privacy Policy explains how we handle your information.

If you don’t agree, please don’t play. If you’re under 18, please read these terms with a parent or guardian.

2 Who Can Play

  • You must be 13 or older to play Club NYC. We ask for your birth month and year when you create your New Yorker.
  • The law where you live may say that someone your age needs a parent’s or guardian’s permission to use online services or to agree to terms like these. If so, you need that permission before you play, and the parent or guardian who gives it agrees to these terms for you.
  • If we’ve banned you, you can’t play. You also can’t make new accounts to get around a mute, suspension or ban.

3 Your Account

  • Guest accounts. “Play Now” creates a guest account right away, with no email. It’s tied to a cookie in your browser, so if you clear your cookies or switch devices before linking a sign-in, you may not be able to get back into it.
  • Linked sign-ins. Link Google, X (formerly Twitter), Discord or your email to keep your account across devices. Email sign-in links are for you only: don’t forward them.
  • Keep it secure. Look after your sign-in, and don’t share, sell or trade your account. You’re responsible for what happens on it. If you think someone else is using it, email [CONTACT EMAIL].
  • Names. Your in-game name has to follow the Community Rules. Moderators can reset names that don’t.
  • Breaking the rules. We may suspend or delete accounts that break the Community Rules or these terms (see section 10).
  • Leaving. You can delete your account at any time: Player Card → Account → Delete Account.

4 Coins and Items

  • Coins are a free in-game currency that you earn by playing. You can spend them on things in the game, like clothes and furniture.
  • You don’t own coins or items. Instead, we give you a personal, limited license to use them in Club NYC. You can’t transfer this license, and it ends if your account is deleted or banned.
  • Coins and items have no real-money value. They can’t be bought, sold or exchanged for money or for anything outside the game, and they can’t be cashed out. Don’t trade them (or accounts) for real money.
  • We may change, add or remove items, and adjust coin balances and items, for example to fix bugs, undo cheating or rebalance the game.
  • There are no real-money purchases in Club NYC today. If that ever changes, we’ll update these terms first.

5 Your Content

“Your content” means what you create or share in Club NYC, like chat messages, your in-game name and guestbook notes.

  • You’re responsible for it. It has to follow the Community Rules, and you need the right to share anything you post.
  • You keep your rights. You keep any rights you have in your content. So that we can run the game, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display and send your content within Club NYC, and to review it for safety. This license ends when your content is deleted from our systems, except for copies kept in reports, moderation records or backups for as long as our Privacy Policy describes.
  • We can remove it. We may remove, hide or filter content, and reset names, when we think it breaks the rules or could hurt someone. Our chat filter does some of this automatically.
  • Chat is live. We can’t review everything before it appears, and we’re not responsible for what other players say. Please report anything that breaks the rules.

If you think something in Club NYC infringes your copyright or other rights, email [CONTACT EMAIL] and tell us what it is and where to find it.

6 Playing Fair

Follow the Community Rules everywhere in the game. In particular, don’t:

  • cheat, exploit bugs, or use bots, scripts or other automated play;
  • hack, overload or interfere with Club NYC or our servers, or try to get into accounts or data that aren’t yours;
  • pretend to be Club NYC staff or another player;
  • use Club NYC to scam, spam or advertise, or for anything illegal.

Found a bug? Please tell us at [CONTACT EMAIL] instead of using it. Thank you!

7 Our Game, and the Real New York

  • The game is ours. Club NYC (its code, art, characters and name) belongs to [COMPANY NAME] or to the people who license it to us. We give you a personal, non-commercial permission to play it, which we can take back if you break these terms. Please don’t copy, sell or redistribute the game or its art. You’re welcome to share screenshots and videos of your own play.
  • It’s a parody. Club NYC is a cartoon version of New York, and all the brands in it are parodies. It isn’t affiliated with, endorsed by or sponsored by any real business, organization, sports team or public figure mentioned in the game, including in the Club NYC Times, our fictional newspaper.

8 Early Access, Provided “As Is”

Club NYC is in early access, which means:

  • Things will change. We may add, change or remove features, places, items and games at any time.
  • Things may break. There will be bugs. We keep backups, but we can’t promise your progress will never be lost.
  • It may go offline for maintenance, because something broke, or for good.

Some places don’t allow these disclaimers, so some of them may not apply to you.

9 Limitation of Liability

Nothing in these terms limits any liability that can’t be limited by law, including your rights under the consumer protection laws where you live.

10 Suspensions, Bans and Leaving

  • You can leave at any time. Stop playing whenever you like, or delete your account in the game.
  • If you break the rules, we may warn you, mute you, suspend your account (for example, for 1 or 7 days) or ban it permanently, depending on what happened. Serious harm means an immediate permanent ban. The Community Rules explain how this works.
  • We may also suspend or close accounts when the law requires it, or to protect players or the game.
  • Appeals. Think we got it wrong? Email [CONTACT EMAIL] with your in-game name.
  • If Club NYC closes. We may shut the game down. If we decide to close it for good, we’ll try to let players know in the game first.

Sections 4, 5, 7, 8, 9 and 12 keep applying after your account ends.

11 Changes to These Terms

We may update these terms as Club NYC grows. When we do, we’ll change the “Last updated” date at the top. If a change is important, we’ll ask you to read and agree to the new version in the game before you keep playing. If you don’t agree, you can stop playing and delete your account.

12 Governing Law and the Fine Print

  • Governing law. These terms are governed by the laws of the State of [GOVERNING STATE], USA, without regard to its conflict-of-law rules.
  • Talk to us first. If you have a problem with Club NYC, please email [CONTACT EMAIL] before anything else. Most things can be sorted out quickly.
  • Courts. Any legal dispute about Club NYC will be handled in the state or federal courts located in [GOVERNING STATE]. If you live outside the US, nothing here takes away the protections of your local consumer laws, or any right those laws give you to bring a claim in your local courts.
  • Everything else. If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce something right away, we haven’t given up the right to. These terms and the Community Rules are the whole agreement between you and us about Club NYC. You can’t transfer your rights under these terms to anyone else. We can transfer ours, for example if Club NYC is sold.
